Utah Sports Betting in 2026: Is It Legal, and What Are Your Options?

Sports betting is illegal in Utah, which has no sportsbook, casino or lottery, because the state constitution has barred the Legislature from authorizing any game of chance since statehood. On August 4, 2026 a federal judge ruled that Utah's gambling laws also reach Kalshi's sports contracts, and in September the Tenth Circuit refused to block Utah from enforcing its law while Kalshi appeals. The Jazz and the Mammoth play at the Delta Center in Salt Lake City, and the Utes and BYU play Big 12 football about 45 miles apart. Prediction markets list those games, and the state says trading them from Utah is illegal.

Is Sports Betting Legal in Utah?

Sports betting is not legal in Utah, where the criminal code defines gambling as staking something of value on a result that depends on chance, and since May 6, 2026 that definition has listed a lottery and a proposition bet by name. Online gambling is the same activity done over the internet or on any mobile device. Under Utah Code 76-9-1402, participating in gambling, including online gambling, is a class B misdemeanor, and a class A misdemeanor for a repeat conviction. Under 76-9-1404, intentionally offering online gambling to anyone in Utah is a third-degree felony.

Tribal casinos aren't an option, because the federal Indian Gaming Regulatory Act lets tribes offer casino gaming only in a state that "permits such gaming for any purpose by any person, organization, or entity," and Utah permits none.

The closest legal sportsbooks to Salt Lake City are over the state line: Wyoming's mobile apps, which that state authorized in April 2021, and Nevada's licensed sports pools.

What the Utah Constitution Says About Gambling

Section 27 binds the Legislature itself, so any legal sportsbook would first need a constitutional amendment, which takes a two-thirds vote of all members elected to each chamber and then approval from most voters at the following general election. The text of Section 27 hasn't changed since 1896.

In 2026 the Legislature tightened the law with HB 243, Gambling Revisions, sponsored by Rep. Joseph Elison, with Sen. Brady Brammer carrying it in the Senate. It defines a proposition bet as "a gambling bet on an individual action, statistic, occurrence, or non-occurrence" and lists it as gambling. The House passed it 63 to 9 on February 10 and the Senate 25 to 0 on February 27, and after Gov. Spencer Cox signed it on March 25 it took effect on May 6.

Pick'em fantasy apps are built on calls about individual player stats, and HB 243 doesn't mention fantasy sports. Utah has no fantasy sports statute and no fantasy exception in its gambling definitions, so whether a pick'em entry counts as a proposition bet is a question its courts haven't answered.

The Kalshi Case in Utah

Kalshi sued Gov. Cox, Attorney General Derek Brown and three of Brown's deputies in federal court in February 2026, asking for a ruling that the Commodity Exchange Act preempts Utah's gambling laws. On August 4, U.S. District Judge Robert J. Shelby granted the state summary judgment. He held that the act doesn't preempt Utah's enforcement of its anti-gambling laws against Kalshi, denied Kalshi's request for a preliminary injunction and closed the case. A group of 23 tribes and tribal gaming associations had asked to file a brief on Utah's side.

"You can't rebrand illegal gambling as a federal commodity," Brown said that day. Kalshi appealed, and on September 8 two Tenth Circuit judges turned down its emergency motion for an injunction pending appeal, so no court order stops Utah from enforcing its law against Kalshi now. As of October 5 the attorney general's office had announced no letter or lawsuit against any other platform.

Novig, operated by Ludlow Exchange, LLC, a CFTC-designated contract market since June 16, 2026, isn't a party to the Utah case. It lists itself as available nationwide to users 21 and over, and eligibility turns on where you're physically located when you place a trade. Utah's position, stated by its governor and attorney general and backed for now by a federal court, is that sports contracts on these markets are gambling under state law, which would make trading them from Utah a misdemeanor. Check the platform's terms and the status of the appeal before trading from Utah.

Utah Sen. John Curtis and California Sen. Adam Schiff introduced the Prediction Markets Are Gambling Act, S. 4160, on March 23, 2026. It would bar CFTC-registered platforms from listing contracts that resemble a sports bet or a casino-style game. It went to the Senate Agriculture Committee that day and hasn't moved since.

How Prediction Markets Work

On a prediction market, the result of a BYU game is a contract that pays out if the outcome happens, and its price, which moves as traders bid and offer against each other, is the market's estimate of the odds. You can buy at the current offer or enter the price you'd pay, and your order stays on the book until a seller agrees to it.

The nearest legal books, in Wyoming and Nevada, make their money from the vig built into each line, which isn't listed as a separate charge. A prediction market that charges anything publishes the amount on a fee schedule you can read before you trade.

No Utah agency licenses prediction markets, which are federally regulated by the CFTC, and the federal court in Salt Lake City has ruled that federal oversight doesn't stop Utah's gambling laws from applying.

What to Look For When Comparing Options

  • Legal posture in Utah: whether the platform is in litigation with the state and what its own terms say about Utah users, with Kalshi's Tenth Circuit appeal as the pending case.
  • Who takes the other side: the counterparty on a prediction market is another trader, and in pick'em fantasy it depends on the contest type, since some pit you against other entrants and others pay from a fixed table.
  • What a trade costs: some platforms charge on every contract or take a cut of winnings while others charge nothing on pregame trades, and some don't charge makers, who post a price and leave it on the book for someone else to take.
  • Depth: on thinner markets, compare the bid and the ask before you take a number, because the gap between them is part of what the trade costs.
  • What's listed: anyone following the Jazz or BYU should check the depth of NBA and college football markets on each platform.

A Jazz bet at -110 with a Wyoming sportsbook needs 52.4% winners to cover the vig, while a pregame straight trade at even money costs nothing in fees on Novig, so the break-even there is 50%.

What Comes Next

Kalshi's Tenth Circuit appeal, No. 26-4100, hasn't been decided on the merits, and until it is, Judge Shelby's ruling for the state stands. In April 2026 a Third Circuit panel ruled for Kalshi against New Jersey, which has since petitioned the Supreme Court (No. 26-299). Nevada won its Ninth Circuit appeal on August 28, and a Sixth Circuit panel sided with Ohio and Tennessee on September 25. The Fourth Circuit still hadn't decided Maryland's case on October 1, and a Supreme Court ruling on preemption would bind Utah as well.
